Product brand SHADEON®
Introductory provisions:
1. The seller is STÍN KOVO s. r. o., a legal entity registered in the commercial register, with registered address at Bří. Hlaviců 122, Vsetín 755 01.
2. The buyer is an entity that has concluded with the seller a contract on the purchase of goods, namely according to the company's general terms and conditions.
3. The seller undertakes to dispatch the goods in such a way that they are packed in suitable packaging material that meets the requirements for the transport of the given goods and thus prevents the risk of possible damage to the goods during transport.
4. The buyer is obliged to inspect the goods immediately upon their receipt in such a way that the buyer can find defects of the goods while exercising all professional care.
5. If mechanical damage to the packaging of the product is found, the buyer is obliged to record the damage in the handover protocol, or delivery note, namely in the presence of the person who realized the transport.
6. The buyer accepts the delivered goods based on the delivery note. Acceptance of the goods shall be confirmed on the delivery note either by the purchaser or by his authorised representative or employee authorised to do so. Without making the entry according to point 5, by signing it, he agrees that the goods were delivered without obvious defects, that the packaging material was not mechanically damaged, and that the goods was delivered in the quantity declared in the delivery note. All these facts must be verified and confirmed in writing when signing the delivery note, as later complaints will not be taken into account.
7. The buyer is obliged to notify the seller of defects in the goods in writing and to assert a specific claim for liability for defects without undue delay if he could have discovered them during a timely inspection and with sufficient care, otherwise the court will not admit the rights from faulty performance. The same applies to a hidden defect, if it has been reported without undue delay after the buyer could have detected it with sufficient care, but no later than before the expiration of the warranty period, which begins to run at the time of the goods delivery, or the delivery of the goods to the destination specified in the contract (order).
8. The seller cannot be held responsible for any mechanical defects detected outside the delivery destination specified in the contract (order), after obvious handling or transport by the buyer or third parties.
I. Warranty conditions
1. In the event that defects in the goods occur after the buyer has taken over the goods and within the warranty period, the buyer can make a valid complaint. The warranty period begins to run at the day of sale - handover of the goods, as it is indicated on the delivery note.
2. The length of the warranty period is 24 months, unless specified otherwise.
3. The warranty expires in the following cases:
a. Expiry of the warranty period.
b. Violation of protective seals and stickers, if used on the product.
c. Improper use and storage of the goods.
d. Not following the instructions set by the manufacturer or supplier.
e. Unprofessional installation, handling, service, manipulation or neglected care of the goods.
f. The goods were damaged by the elements.
g. In the event of a breach of the buyer’s obligations arising from points 4 to 7 of the Introductory Provisions – mechanical and quantitative defects (non-production defects).
h. If a complaint is made according to point 8 of the Introductory Provisions – mechanical and quantitative defects (non-production defects).
4. In the event of a complaint related to already installed shading equipment and other products, the warranty applies only to those defects that are visible at a distance of 3/5 meters (int/ext), provided that the building was realized accordance with the installation conditions for shading and other assortment, valid at the time.
II Complaint handling
1. Any complaint will be admitted for further processing only if it is submitted in writing, i.e. by properly filling out the complaint report (which forms an integral part of the Complaints Code) and delivering it to the supplier by fax, post, e-mail or in person.
2. Together with the complaint report, it is always necessary to submit the documents on the goods sale issued by the seller to the buyer. The buyer is obliged to hand over the claimed goods to the seller in complete, intact and clean state, packed in suitable packaging material that meets the requirements for the transport of the given goods, preferably in the original packaging due to the risk of possible damage to the goods. If the buyer does not do so, the seller is entitled to reject the claim.
3. Upon detection of a difference in the quantity or type of goods given on the invoice and the delivered goods, the buyer is obliged to submit a written report of these defects to the seller within seven working days. If this deadline is not met, the complaint cannot be admitted. In the event that this complaint is recognized as justified, the buyer can demand the delivery of demonstrably missing goods - in the case of a quantitative defect - or the exchange of goods of a different type for the goods originally ordered by the buyer - in the case of a type defect.
4. If the claim was unjustified (according to clauses 4 and 5 of the Warranty Conditions), the seller will charge the buyer all incurred costs for localization, logistics, finding the necessary data, testing, etc. The buyer is obliged to pay these costs immediately, but no later than fourteen days after the end of the complaint procedure. Without payment of the incurred costs, the goods that are the subject of the complaint will not be handed over to the buyer.
5. The goods cannot be reclaimed in the case of inaccurate data and photos presented on the seller's website.
6. If the complainant does not agree with the decision of the responsible employee, he can contact the owner of the company or the seller's representative in writing.
7. If it deals with an irreparable defect, which does not prevent the use of the goods for the intended purpose, the buyer is entitled to a reasonable discount from the purchase price; in the event that this defect makes it significantly more difficult to use the product, he is entitled to exchange the goods for faultless goods, which with their age and wear correspond to the claimed item.
8. If the complainant does not agree with the decision of the responsible employee, he can contact the owner of the company or the seller's representative in writing.
9. The complainant cannot change already made complaint claims, unless agreed otherwise.
10. The seller is obliged to notify the result of the complaint procedure to the complaining party, provided that all obligations resulting from this complaint procedure have been fulfilled.
11. Justifiability of each complaint and the removability or non-removability of the defect is always assessed by the seller's professional responsible employee (sales representative) who communicates his opinion to the buyer within "7" working days at the latest. In the case of a justified complaint, the seller is obliged to settle the complaint within a period reasonable according to the defect nature, but no later than "60" working days after its proper making, unless both parties agree otherwise in writing.
12. In the event that the buyer requests the delivery of new, faultless goods prior to returning the claimed goods or prior to the completion of the complaint procedure, the seller will charge for these goods. If respective complaint is later resolved positively, a credit note is issued.
13. This Complaints Code replaces the previous complaint code and is valid from 1 January 2019.
III Warranty coverage
The following defects are not covered within the warranty:
External Venetian blinds
- The differences in dimensions that fall within respective manufacturing tolerances, as communicated to the buyer upon request.
- The differences caused by incorrect filling the order form by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by incorrect installation by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by installation in an unsuitable environment.
- The defects notified to the customer in advance (too small/big dimensions, manufacturing tolerances, etc.).
- The defects caused by an atypical design, as the customer was advised in advance.
- The differences in colours of slats, profiles and other components in the case of the orders that are produced in multiple parts, i.e. with different delivery dates.
- The differences in slat shades when larger volumes in given colour are manufactured.
- Grain differences in wood imitations.
- The defects caused by misuse or improper use of the product.
- The defects caused by mechanical damage by the user.
- Our products are designed for shading, not for blackout. This fact also cannot be the subject of a complaint.
- In the case of a complaint related to motor, its supply cable has to be of the original design.
- The defects caused by weather effects and exceeding their limits.
- The differences in the shade of standard colours compared to the colours within the RAL colour chart. The RAL numerical designations given for standard colours represent the closest shade of the colour, so it is not an exact shade according to the RAL colour chart.
External roller shutters
- The differences in dimensions that fall within respective manufacturing tolerances.
- The differences caused by incorrect filling the order form by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by incorrect installation by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by installation in an unsuitable environment.
- The defects notified to the customer in advance (too small/big dimensions, manufacturing tolerances, etc.).
- The defects caused by an atypical design, as the customer was advised in advance.
- The differences in colours of slats, profiles and other components in the case of the orders that are produced in multiple parts, i.e. with different delivery dates.
- The differences in slat shades when larger volumes in given colour are manufactured.
- Grain differences in wood imitations.
- The defects caused by misuse or improper use of the product.
- The defects caused by mechanical damage by the user.
- Our products are designed for shading, not for blackout. Light can penetrate in the area of the guide rails, in the area of the slat perforation and in the area of the box. This fact cannot be the subject of a complaint.
- Wear of and imprints on the upper slats caused by the stack holders.
- Wear of the stack in the area of internal part of the guide rail that is not visible when looking directly at the stack.
- In the case of a complaint related to motor, its supply cable has to be of the original design and at least 30 cm long.
- The differences in the shade of standard colours compared to the colours within the RAL colour chart. The RAL numerical designations given for standard colours represent the closest shade of the colour, so it is not an exact shade according to the RAL colour chart.
Awnings
- The differences in dimensions that fall within respective manufacturing tolerances.
- The differences caused by incorrect filling the order form by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by incorrect installation by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by installation in an unsuitable environment.
- The defects notified to the customer in advance (too small/big dimensions, manufacturing tolerances, etc.).
- The defects caused by an atypical design, as the customer was advised in advance.
- The differences in colours of fabrics, profiles and other components in the case of the orders that are produced in multiple parts, i.e. with different delivery dates.
- The differences in fabric and slat shades when larger volumes in given colour are manufactured.
- The defects caused by misuse or improper use of the product.
- The defects caused by mechanical damage by the user.
- Our products are designed for shading, not for blackout. This fact also cannot be the subject of a complaint
- The defects caused by improper cleaning of or damage to the fabric due to the environment (exhalates, bird droppings etc.).
- The defects caused by rain. The awning could not serve as a roof for protection against rain. The awning should remain retracted when it rains. If the awning fabric gets wet, it is necessary to extend the awning and let it dry out as soon as possible.
- The defects, the cause of which lies in the very nature of each fabric, are also excluded from the complaints. These defects do not reduce the value or usability of the awning in any way:
* Creases that occur during assembly and folding of finished fabrics within their shipment. At the fold, the colour of the fabric may appear darker or lighter due to different reflection of light on the fabric surface. so-called chalk effect.
* Waving – It may appear near the seams or in the middle of individual stripes of fabric. Different forces are applied to the fabric during its use, caused by doubling the mass of the fabric in the seams and underlays, by pulling the retractable arms, sagging the cylinder or front profile, etc. Stress can create a so-called waffle effect or fishbone effect. This deformation can occur also when water has collected on the coating during heavy rain and so-called bowl or belly has been created.
* Edge rolling – the fabric is kept under constant tension thanks to the active spring system. The seams and underlays act as reinforcements and are able to compensate for most stresses. During rolling, the seams and tabs are compressed and so they get stretched over time. All this can cause the edges of the fabric slightly sag when the awning is extended. - In the case of a complaint related to motor, its supply cable has to be of the original design and at least 30 cm.

Screen roller blinds

- The defects caused by incorrect installation by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by installation in an unsuitable environment.
- The defects notified to the customer in advance (too small/big dimensions, manufacturing tolerances, etc.).
- The defects caused by an atypical design, as the customer was advised in advance.
- The differences in colours of fabrics, profiles and other components in the case of the orders that are produced in multiple parts, i.e. with different delivery dates.
- The differences in fabric shade when larger quantity in given colour is manufactured.
- The defects caused by misuse or improper use of the product.
- Our products are designed for shading, not for blackout. This fact cannot be the subject of a complaint.
- The defects caused by improper cleaning of or damage to the fabric due to the environment (exhalates, bird droppings etc.).
- The defects caused by rain. The roller blind could not serve as a protection against rain. The roller blind should remain retracted when it rains. If the fabric gets wet, it is necessary to extend it and let it dry out as soon as possible.
- The defects caused by wind force, even when wind sensor is installed (in the event of a sudden strong gust of wind while retracting).
- The colour fastness of fabrics cannot be guaranteed because of the sun action.
- The defects, the cause of which lies in the very nature of each fabric, are also excluded from complaints. These defects do not reduce the value or usability of the roller blind in any way:
* Waffle effect- This phenomenon occurs due to the fabric strain caused by different forces during use. For example, by pulling from the bottom profile, doubling the mass of fabric in the seams and underlays, deflection of the shaft or bottom profile, etc.
* Edge rolling - When winding and unwinding the fabric, the seams and tabs are compressed and stretched over time. This can cause the edges of the fabric sag or become wavy.
Folds in fabric seam or edge - This phenomenon occurs during winding due to the connection of the fabric and the zipper.
Area deformations in the fabric - They occur on roller blinds with a large shading area due to the combination of fabrics and their total weight.
Transverse imprints in the area - They are caused by the connection of the fabric to the shaft and by imprinting the transverse joints on the fabric.
Fabric fading - It is caused by sunlight affecting the fabric material. More details can be found in following standard: EN ISO 105-B02:2014.
Chalk effect - At the fold, the colour of the fabric may appear darker or lighter due to different reflection of light on the fabric surface.
Fibre weaving in - It is a result of accumulation of lint and its incorporation into the fabric during the fabric production process.
Sandglass effect - This phenomenon is characterized by a horizontal narrowing and simultaneous vertical elongation of the fabric, which over time occurs because of the fabric weave loosening. This can happen with fabrics that are produced by weaving technology.
Expansion of fabrics - Fabrics for screen roller blinds, as well as all other materials, have their own physical properties that change depending on external influences. In this case, we are talking about the natural expansion of the material in response to the surrounding climatic conditions.
In the case of a complaint related to motor, its supply cable has to be of the original design and at least 30 cm.

- Slant running for the blinds up to 1.5 m high, the tolerance of slanting at the ends of the blinds is ± 6 mm, this tolerance is ± 8 mm for the heights above 1.5 m. It is assessed in end positions.
- Incomplete closing of the blind slats in the entire area.
* Venetian blinds usually do not close equally and evenly over the entire height (they tend to be closed better in the upper part and more ajar in the lower part). This fact is a design feature and cannot be considered a defect of Venetian blinds. The Venetian blinds are sufficiently closed, when they block a direct light flow that falls directly on the blinds plane, namely over their entire height. This requirement does not apply to the cut-outs in the slats and the gap between the upper beam and the first slat. Pleated fabric blinds

- Blind strings, especially in the case of larger sizes, stretch over time and lose elasticity. This can cause imperfect holding of the blinds and their occasional descent in the direction of gravity. For this reason, it is necessary to adjust the blinds in the opened state to the required position from time to time. This defect does not reduce the value or usability of the product in any way.

- Seemingly imperfect tension of the screen - screen manufacturing process results in “sufficient” tension of the screen, which is not measurable and cannot be the subject of a complaint procedure unless it hinders the product functionality.
- The defects in the operation of sliding and pleated blinds caused by the installation in a dusty or otherwise polluted environment.

Sectional garage doors
- The differences in dimensions that fall within respective manufacturing tolerances.

- Possible clearance between the top panel and the door head.
- Possible wear and stamping with sealing rubber, especially on the panel edges. In the current state of technology, this is caused by the design of the door and cannot be avoided.
- Bending of the panels, which can be caused by large temperature differences between the interior and exterior (bi-metal effect).
- Built-in pedestrian door leaks. (Built-in pedestrian door is a functional element that significantly affects/reduces the thermal insulation properties of the door. Due to it installation in movable panels, leaks may occur, which may affect the overall appearance of the door).
- The differences in the shade of standard colours compared to the colours within the RAL colour chart. The RAL numerical designations given for standard colours represent the closest shade of the colour, so it is not an exact shade according to the RAL colour chart.
Rolling garage doors
- The differences in dimensions that fall within respective manufacturing tolerances.
- The differences caused by incorrect filling the order form by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by incorrect installation by persons other than the seller (e.g. the buyer, his authorized persons, etc.).
- The defects caused by installation in an unsuitable environment.
- The defects notified to the customer in advance (too small/big dimensions, manufacturing tolerances, etc.).
- The defects caused by an atypical design, as the customer was advised in advance.

Pergolas

- Wear and tear on parts caused by normal use and exposure to atmospheric influences

VERDI - Defects caused by use of the product at temperatures below 0 °C, opening and closing of the slats is prohibited.
- The accidental occurrence of water droplets on the roof where there is no solid insulated roofing. There are gaps between the slats and around the sides of the frame where water droplets can appear in the event of a combination of rain and strong winds. When these negative circumstances combine, water can also enter the space between the individual slats.
LOIRA, TIRA - If the pergola is located in an area where there is a risk of snow falling on the roof of the pergola, the client is obliged to take measures to prevent the snow from falling. He is also obliged to remove snow from the pergola roofs if the snow cover is higher than 10 cm. If the pergola is damaged for this reason, it will not be accepted as part of the warranty claim.
ZIRCA - Defects caused by the use of the product in winter, if there is a risk of snow and frost. The roof must not be additionally loaded with the weight of snow or ice.
- Water can remain in the lower segment of the fabric and then flow out the sides when the roof moves to the upper position. The fabric is loaded by its weight and the weight of the profiles therefore the fabric cannot be absolutely flat.
